1. General Information

  1. This privacy policy applies to the website operating under the address: gotkubek.com.

  2. The operator of the website and the Controller of personal data is: LVG Europe Sp. z o.o., Poczernin 47, 09-142 Załuski, Poland.

  3. Contact with the Controller is possible at the following e-mail address: gotkubek@gotkubek.com.

  4. The Operator is the Controller of your personal data in relation to the data provided voluntarily within the Service.

  5. Personal data provided on the website are processed in accordance with the GDPR for the following purposes and legal bases:
    a. handling contact forms (Article 6(1)(b) GDPR),
    b. execution of orders and services, including shipment of goods (Article 6(1)(b) GDPR),
    c. bookkeeping and accounting (Article 6(1)(c) GDPR),
    d. pursuing or defending against claims (Article 6(1)(f) GDPR),
    e. marketing of own products and services (Article 6(1)(f) GDPR, and in cases requiring consent – Article 6(1)(a) GDPR).

  6. Personal data are not transferred outside the European Economic Area unless explicitly stated otherwise.

2. Selected Data Protection Methods Used by the Operator

  1. Login areas and entry of personal data are protected at the transmission layer (SSL certificate). This ensures that personal data and login details entered on the site are encrypted on the user’s computer and can be read only on the target server.

  2. The Operator periodically changes its administrative passwords.

  3. In order to protect data, the Operator regularly performs backups.

  4. An important element of data protection is the regular update of all software used by the Operator to process personal data, which in particular means regular updates of software components.

3. Hosting

  1. The Service is technically maintained on the servers of the operator: home.pl.

  2. For technical reliability, the hosting company keeps server-level logs. These logs may include:
    a. resources specified by a URL identifier (addresses of requested resources – pages, files),
    b. the time of request arrival,
    c. the time of response,
    d. the name of the client station – identification carried out by the HTTP protocol,
    e. information about errors that occurred during HTTP transactions,
    f. the URL address of the previously visited page (referrer link) if the Service was accessed through a link,
    g. information about the user’s browser,
    h. IP address information,
    i. diagnostic information related to the self-ordering process via recorders on the site,
    j. information related to e-mail handling directed to and sent by the Operator.

4. Your Rights and Additional Information on Data Processing

  1. In certain situations, the Controller has the right to transfer your personal data to other recipients if it is necessary to perform a contract concluded with you or to fulfil obligations incumbent on the Controller. This applies to the following groups of recipients:
    a. hosting company on the basis of entrustment,
    b. couriers,
    c. entities providing legal and debt collection services,
    d. authorized employees and associates who use the data to achieve the purpose of operating the website,
    e. companies providing marketing services on behalf of the Controller.

  2. Your personal data will be processed no longer than is necessary to perform activities related to them as specified by separate regulations (e.g. accounting regulations). With regard to marketing data, they will not be processed for longer than 3 years.

  3. You have the right to request from the Controller:
    a. access to your personal data,
    b. rectification,
    c. erasure,
    d. restriction of processing,
    e. and data portability.

  4. You have the right to object to the processing of personal data referred to in point 3.2 for the purpose of legitimate interests pursued by the Controller, including profiling, with the exception that the right to object may not be exercised where there are compelling legitimate grounds for the processing overriding your interests, rights and freedoms, in particular establishing, exercising, or defending legal claims.

  5. You have the right to lodge a complaint with the President of the Personal Data Protection Office (PUODO), ul. Stawki 2, 00-193 Warsaw, Poland.

  6. Providing personal data is voluntary, but necessary to use the Service.

  7. Automated decision-making, including profiling, may be carried out with respect to you in order to provide services under the concluded contract and for direct marketing by the Controller.

  8. Personal data are not transferred to third countries within the meaning of data protection regulations. This means that we do not transfer them outside the territory of the European Union.

5. Information in Forms

  1. The Service collects information voluntarily provided by the user, including personal data if provided.

  2. The Service may record information about connection parameters (time indication, IP address).

  3. In some cases, the Service may save information facilitating the linking of form data with the e-mail address of the user completing the form. In such a case, the user’s e-mail address appears inside the URL of the page containing the form.

  4. Data provided in the form are processed for the purpose resulting from the function of the specific form, e.g. to process a service request or business contact, registration of services, etc. Each time the context and description of the form clearly indicate what it is used for.

6. Administrator’s Logs

  1. Information about user behavior in the Service may be subject to logging. These data are used for site administration.

7. Important Marketing Techniques

  1. The Operator applies statistical analysis of site traffic through Google Analytics (Google Inc., USA). The Operator does not transfer personal data to the provider of this service, only anonymized information. The service uses cookies on the user’s end device. Within the scope of information about user preferences collected by Google’s advertising network, the user can view and edit information derived from cookies using the following tool: https://www.google.com/ads/preferences/.

  2. The Operator uses a solution that analyzes user behavior by creating heatmaps and recording on-site behavior. This information is anonymized before it is sent to the service provider, so that the provider does not know which individual it relates to. In particular, passwords and other personal data are not recorded.

  3. The Operator uses a solution that automates the Service in relation to users, e.g. which may send an e-mail to a user after visiting a specific subpage, provided that the user has consented to receive commercial correspondence from the Operator.

8. Information on Cookies

  1. The Service uses cookies.

  2. Cookies are IT data, in particular text files, stored in the end device of the Service User and intended for using the Service’s websites. Cookies usually contain the name of the website they come from, the time of storage on the end device, and a unique number.

  3. The entity placing cookies on the Service User’s end device and accessing them is the Operator of the Service.

  4. Cookies are used for the following purposes:
    a. maintaining the Service User’s session (after logging in), thanks to which the User does not have to re-enter login and password on each subpage of the Service,
    b. implementation of the purposes set out above in the section "Important Marketing Techniques".

  5. Within the Service, two basic types of cookies are used: “session cookies” and “persistent cookies.” Session cookies are temporary files stored on the User’s device until logout, leaving the website, or closing the software (web browser). Persistent cookies are stored on the User’s device for the time specified in the parameters of the cookies or until deleted by the User.

  6. Web browsing software (web browser) usually by default allows storing cookies on the User’s device. Service Users may change settings in this respect. The web browser allows deletion of cookies. It is also possible to block cookies automatically. Detailed information on this is provided in the browser help or documentation.

  7. Restrictions on the use of cookies may affect some of the functionalities available on the Service websites.

  8. Cookies placed on the User’s end device may also be used by partners cooperating with the Service Operator, in particular by companies: Google (Google Inc., USA), Facebook (Facebook Inc., USA), Twitter (Twitter Inc., USA).

  1. If the user does not wish to receive cookies, they may change their browser settings. Please note that disabling cookies necessary for authentication processes, security, or maintaining user preferences may hinder or, in extreme cases, prevent the use of websites.
